BJP's proposed Communal Uniform Civil Code in India!

Bharat me Uniform Civil Code nahi aana chahiye!



BJP Narendra Modi with their ingrained hatred philosophy against Muslims and Christians want to bring up Uniform Civil Code in India. Uniform Civil Code sounds good but their version would not be secular, their age old traditions listed in Manusmriti Codex which preaches hatred against women and backward class people, which preaches caste system and untouchability, which is glorified in BJP because of their RSS (Hindu Taliban) roots. This they want to become Uniform Civil Code, just the name of this codex would be replaced with Uniform Civil Code and imposed over Secular India.

BJP states that it is the Constitution of India which asks state to endeavor for a Uniform Civil Code in India, so they must bring in such a code. Currently, due to India’s plurality and secularism, personal matters i.e. marriage, divorce, inheritance, adoption, charity, donation etc are governed by personal laws of respective religions. Although, Constitution asks the state to endeavor, it never asks to impose drastically; it only asks to try it gradually. This concept comes from ‘Directive Principle to the State Policy’ part of Constitution, which is not a part of primary importance.

Fundamental Rights as part of Constitution are of prime importance. But, it is an open truth where India stands when it comes to application of fundamental rights. A vast number of people still struggle for food, clean water, proper clothes and shelter; people are devoid of educational and medical facilities. Fundamental rights are guaranteed to every citizen, yet to be accomplished up to the last Indian, and whole BJP under Narendra Modi is struggling to expand their vicious philosophy and transform India into a Hindu Rashtra (Hindu Talibanisation of India) which is their dream project.

Uniform Civil code is a paradox in Indian constitution as per what I understand. That is because on one hand India is a federation under the same constitution with states having their own governments. The central government has no right to make laws on subjects listed in state list. Every state has its own law on those subjects, which one comes to know when one travels from one state to another, liquor is banned in this state allowed in the next, beef is banned in this state allowed in the next. So where is the uniformity?

Such uniform civil codes are suitable for countries which are unitary and not a federation, like Bangladesh, where there are no state governments, a single central government makes laws on all issues, and it get uniformly applied to every corner of such country. Then too, I don’t feel, idea of Uniform Civil code should be scrapped from our constitution. We should leave the topic for future generation, and should concentrate on eminent problems in front of us.

Uniform Civil Code is already present in genesis stage in India; we have a civil marriage act, through which people belonging to two different religions can marry. This code never prohibits people from same religion to marry as per this act. Supporters of BJP and Narendra Modi when they marry why don’t they boycott their religious marriage code and marry as per civil marriage act to support their this philosophy, they would never do that, because that is never their intention, their intention is solely communalization.

There are Hindu codes; Hindu marriage act, Hindu divorce act, Hindu succession act, Hindu adoption act, Hindu joint family act, only Hindus can avail their provisions, no Muslim or Christian can avail their provisions. Muslim personal Laws were enacted in 1938 in British era, while Hindus acts were enacted after independence in 1950s. So why BJP or Narendra Modi never talks about Hindu codes why they are always busy to project Muslim laws in bad light?

Recently, Pakistan passed Hindu personal law bill in their parliament, so their minority Hindus could benefit and make their lives better. Had Pakistan not done this then too, it couldn’t be objected as they have declared their country as Islamic republic, yet they bought it. BJP and paid channels who from morning to night chant: modi modi modi, showed this thing in very positive light, and supported it. It was a good thing and we all must support that. But these same Modi brigade and BJP who support Hindu personal law in Islamic Pakistan are objecting to Muslim and Christian personal laws in Secular India?

India is a country where concept of ‘Unity in Diversity’ rules. We should respect our colourful India image, and let this Narendra Modi, BJP’s cheap tactic to gain votes fail drastically. The whole World should know about the kind of mindset Modi and BJP have. This Narendra Modi is talking about protection of rights of Muslim women who himself has deserted his wife. Modi was Chief Minister of Gujarat for three terms, had filed marital information on election papers, finally when he was filing election papers for Parliaments election as BJP’s PM candidate, people came to know he has a deserted wife, at least, neither he nor his party has any moral right to preach what they themselves don’t practice!
